TERMS & CONDITIONS

Securement of Services, Payment, and Cancellation

In order to secure services, the contactor requires a first installment payment equal to one-third the total cost). The second installment equal to two-thirds of the package price will be due at the wedding date.  The cancellation costs are as follows:

4 Months prior to the wedding: 30%

Up to 4 weeks prior to the wedding: 60% 

Cancellations occurring under 4 weeks prior to the wedding result in 100% payment.

Should client payment be more than 5 days overdue, the contractor reserves the right to withhold all material until payment is received.  Should the payment be overdue for a period of longer than 5 days, the contractor reserves the right to invoice interest in the amount of EURIBOR.

Limited Liability

Total liability, other than the loss or damage of digital files is limited to culpable negligence.

Quality

It is understood that the quality of the production is dependent upon adequate lighting, camera/microphone positions and other conditions not under the control of contractor.

Creative Control

The contractor has complete creative control in all stages of the production (preproduction, production & post production).

Non Compliance

The agreement of the service to perform is subject to proven detention by sudden illness, accidents, acts of God, or any other legitimate condition beyond the control of contractor.  Every reasonable attempt will be made to secure a backup videographer in such an unlikely event.

Property Rights

The original footage will remain the property of contractor.  The client grants the contractor permission to use this footage for marketing purposes.  The client is responsible for all copyrighted music used in the wedding video.

Governing rule of Law: 

In the event of a dispute, the court of jurisdiction is Vienna, and Austrian law.
